Welcome to ElevaHosts. These Terms govern your use of our Web Hosting services, Domain Registration, and our Managed Business Apps (SaaS). By using our services, you agree to these terms.
1. Service Definitions
"Hosting Services" refers to the rental of server space for standard websites using control panels like HestiaCP.
"Business Apps" (or "SaaS") refers to our industry-specific solutions (e.g., FitZone, FaithConnect, DrClick) which consist of a React frontend and an ERPNext backend managed by us.
2. App Subscription & Licensing
When you subscribe to a Business App (e.g., "FitZone"), you are granted a non-exclusive, non-transferable license to use the software for your business operations.
- Ownership: You own your business data (client lists, records). ElevaHosts retains ownership of the custom frontend code and the deployment architecture.
- Backend Access: For security stability, full root access to the backend ERP infrastructure is reserved for our administrators unless you are on an "Enterprise" plan.
- Updates: We provide managed updates to ensure security and stability. You agree not to modify the core code in a way that breaks compatibility with our update system.
3. Acceptable Use
Our platform is designed for professional business use. You agree not to use our services for:
- Illegal activities or storing prohibited content.
- Sending unsolicited bulk emails (SPAM).
- Hosting malware or phishing pages.
- Excessive resource usage (e.g., crypto mining) on shared instances.
Violation of these rules will result in immediate suspension of your instance without refund.
4. Payments & Refunds
Hosting: We offer a 30-day money-back guarantee for standard web hosting plans.
Business Apps: Due to the manual setup and cloning costs involved in deploying specific App instances, setup fees are non-refundable. Monthly subscriptions can be cancelled at any time before the next billing cycle.
Domains: Domain registration fees are paid to third-party registrars and are strictly non-refundable once the domain is registered.
5. Infrastructure & Availability
We host our services on enterprise-grade OVHcloud VPS infrastructure. While we strive for 99.9% uptime, we are not liable for outages caused by upstream provider failures, force majeure events, or scheduled maintenance.
6. Limitation of Liability
To the maximum extent permitted by law, ElevaHosts shall not be liable for any indirect, incidental, or consequential damages, including loss of data or business interruption. You are responsible for maintaining your own local backups of critical data.
